What Are Your Rights?

As the birth mother, you can select the adoptive parents that fit your wishes and expectations for your child. Whether the ideal family for your child lives in the suburbs, already has children, would be first-time parents, or any other characteristics, you can choose what feels most comfortable.

A crucial part of the process is making an adoption plan. This plan will determine the level of contact you wish to have with your child and their adoptive family. Learning about these plans can help you decide.

Open Adoption

With an open adoption, you’ll select the parents and determine the best communication style, whether it’s letters, in-person visits, phone calls, or other methods. You can form a relationship with your child and be a continuous presence in their life.

Please note that open adoptions are not legally enforceable in Texas. You can speak with an adoption specialist or attorney to learn your specific rights.

Semi-Open Adoption

Semi-open adoption allows for communication but ensures certain private information is protected. For example, you and the adoptive family can communicate, but all contact is mediated through a third party (like an adoption agency or attorney).

Limited information (like first names) can be shared.

Closed Adoption

A closed adoption offers the most privacy, and although it is more uncommon, it may be ideal if you wish to remain anonymous. With this type of adoption, all identifying records are sealed, and you will not communicate with the adoptive family or your child.
